I purchased a flat from Ferrous Infrastructure & Builders Pvt Ltd in July in a second purchase from their registered property dealer Sri Ganesh Properties Faridabad this flat was orignally purchased/alotted to Mr. Alok Agarwal who was not paying his installments for quite sometime and there was some interest leivied on his non payment.
Sri Ganesh since he was authorised dealer of Ferrous said you purchase this property from and I make sure that this interest panelty would be waived off. I contacted Ferrous for the same and they confirmed that Sri Ganesh is their broker and they would waive off the panelty. When I did the final transaction I paid all the dues of Alok Agarwal to Ferrous by demand draft and paid cash to SriGanesh in cash for which he gave receipt of the ammount which the original buyer had already paid to builder. The broker in turn gave a discount of Rs 100/sqft and gave a letter from ferrous that on their letter head the property is in your name now this is a no dues certificate duly signed by their Vice President Mr Sunil in fact I did the final transaction in Ferrous office at Gurgaon. Ferrous encashed the drafts and started harrasing me. They took all the receipts and builder buyer agreement of alok agarwal from on the pretext of mutation. When I asked for my builder buyer agreement started doing dilly dally. When I checked from their accounts that the interest penealty was not removed. After lot harrasments physical rounds I made to their office they signed builder buyer agreement in Feb. Also start charging the installments. I thought things were sorted out. Till I have already paid 90% of the total charges. Every time I asked for statement of accounts I was given an excuse by their officials Mr. Ashwani & Mr. Alok that their soft is getting updated once it done they would send me the same. Now in December their MD Ashish Seth called me up and said the panalty is still their in the ledger and the property is still in the name of Alok Aagarwal and my employees were doing some fraud in the organization and you need pay this money. When I said I have No Dues from your VP he said if you have the letter please email it us we would protect your interest and penalize our staff. When I sked about the builder buyer agreement he said it is also not valid it is only signed by one authorised signatory and when I said you are giving receipts all the payments I have made so far for that he did not give any answer. I do not know after taking laks of rupees he is saying he does not where my money is getting booked. I sent all the scanned documents on his email id mentioned on his visiting card but he never replied back after getting the documents. After ten days or so sent another reminder of asking a statement of accounts which says the penalty has been waived off. But no responce. I am really worried that my hard earned money fraud and cheating eaten away by some one. I believe you are the only hope. I also would like mention that the possesion was supposed to be handed over in Dec but it is not even close completion and the bulider is in no mood to pay the agreed compensation. The builder has defaulted on all the aspects and there are all ready some consumer complaints against him in consumer court.
Please help me out by having interest waived which he has given in writing, please have my builder buyer agreement validated, please have the agreed compensation given and possession at the earliest.
I am salaried person and buying this property in down payment and finished all my life's saving in buying this property.
