On 4th of Feb i booked one unit in IITL-Nimbus The Hyde park, sector 78 Noida, based on some false promise from them. I book in X tower. When i asked about all sort of approvals, they promised to have all. They also told that the tower is bankable from all banks. So after their assurance, I booked in X tower under flexi plans. According to this plan 10 % is the booking amount with in 2 months, have to 30 % of total. My budget was to pay 20 % from my own resource and the rest by home loan.
I applied for home loan in LIC housing, and got it sanctioned. I went to the head office in first week of march at Laxmi Nagar, New delhi for other papers like BBA and all. Till the time i got BBA signed and counter signed by them, they were very positive. The moment after giving then a copy of the BBA, when i asked about loan related papers, they socked me with the info that, tower X is not yet Bankable. The reason is this is not approved by the Noida authority.
Henceforth they are forcing me to either switch to CLP, which would cost me additional 1.5 Lacs or pay them the 30 % by due date from my own resource or change to some other tower.
As preferred floors are not available in other towers and i can not pay extra 1.5 lacs, i am asking them not to demand till the block is bankable. But they are not agreeing.
So its clear that they cheated me from the very beginning and now forcing me for payment. Also their offcials are not giving proper info. Some one says it will take 1-2 months for approvals, the other saying may take 6 months.
i am really frustrated and annoyed with their conduct. I dont want to give up to their demands.
Can any one tell me how to file a consumer complaint in court?
