I have purchased a flat at Oberoi Springs - and have taken possession of the flat for fit-out purposes.
During the fit-out period, the builder has asked for a deposit of Rs 1 Lakh - which they would return only after 6 months of the work being completed.
Now during the fit-out work, our contractor out tiling work in the dry area up to the ceiling - whereas the builder's architect had "approved" only 3 feet of tiling.
Now the builder - who is currently responsible for building maintenance has stopped my fit-out work by not allowing my contractor to continue work till I remove the extra tiling in the dry area.
The question I have is - whether this is legal on the part of the builder and what the rights of the owner are in this matter?
After all - just doing some extra tiling is hardly something that demands such drastic action - what are the owner's rights in this matter?
What is the builder's legal right on such matters after handing over possession of the flat to the owner?
