Reg: Mayhem by Management of Perfect facility of Orchid Petals

I am writing this letter after getting entirely burnt out by the Promoters of Orchid Petals & Perfect facility mgmt.

I bought an apartment by Orchid Petals in 2006 in Tower no.1, Flat no. 104.Since then I am suffering because of the decision taken by me. Not only they bullied on everyone after delaying the possession by over one year, they also charged a hefty Interest on payment made by everyone instead of paying compensation charges. I am sure that there are over 1000 complaints made by the residents of this colony.

The agony did not end here. Soon after taking possession in Jan the flat started showing seepage & wetting of walls from various rooms. I made several visits to the estate office & complained about it. The excuse given was that as the construction was new, the same shall dry up in days. However few plumbers were sent to check the leakage from taps. They reply was simple:”There is no visible leakage”, so they were helpless. I kept on visiting my apartment to check about the seepage, but it was getting bad to worse.

After extreme persuation, i was given time by one called Mukesh Yadav to visit him and he assured that he would get it checked completely. Twice reaching him, he was never available and every time he asked a plumber to get the seepage checked but they came with the same reply.

After days of following up with him he finally assured that he was available & that I must come then. The result was that he was again unavailable & his mobile was switched off. The duty Manager sent a plumber again called Arun & he then told me that he was advised by Mukesh Yadav to temporarily close the water connection. He advised me that he will again check after few days. Thereafter while I got in touch with Mukesh Yadav, he assured that he would get the same checked & get the walls painted again & the entire damage to the flat shall be removed & reworked as the entire episode had happened due to internal leakage & that he called it as a defect of the project team. The situation got worse even after that.

1) Here all attempts to get in touch with Mukesh Yadav failed as he stopped replying to my Phone calls.

I got in touch with someone called Mr. Fateh Singh. He advised me that he has spoken to someone called the administrator Col. J.S Motharu, he advised him to take the keys of the flat & they would get it thoroughly checked. The keys of my flat were then given to him & received by him (copy attached).he also assured that the complaint would be attended & all walls would be redone again. But for the other damage like wooden flooring & doors repair, I should get in touch with Col Motharu.

As I was advised to get in touch with Col Motharu, he told me that as he was not informed earlier, that was the main cause of damage & he assured me that he would immediately get it checked & all faults shall be repaired. I kept waited for his reply for 3 days but in Vain.

On calling him thereafter, he told me that all those things were checked but nothing has been identified, so he can’t comment on when things would get straightened. He asked me to give time for few more days. After calling him again, he told me that as this was a problem due to construction defect, he would not be able to handle this & was not within his previews.(recording available) He also told me that people pay him visits to get the work done & things do not happen over phone. He Instructed me to talk to Mr. P.K Jain (the only thing common between him & other people was that they kept informing me that the last 3 digits of mobile numbers of other contact were different.

On getting in touch with Mr. P.K Jain, he simply abused Col. Motharu & told me that this person has already gone mad & he was not ready to wear the cap, Col Motharu was trying to remove from his head & trying to put on his head (recording available). He then advised me to talk to his Superior & ED- of Perfect facility, Mr. Anil Behl & gave me last 3 digits of his mobile.

2) I kept calling Col Motharu after this but he stopped taking my calls this time & thereafter.

I then got in touch with Mr. Anil Behl & informed him about the entire story. he consoled me & told me that he would take care of all & also told me that if at all I had reached him earlier, all that damage would have not happened. He told me that he would visit the flat & see the condition of the flat. There after this ED did not call me. I called him the next day & he attempted to defame me saying that I have never spoken to anyone earlier & that I was fabricating the entire episode. He then assured me that he is looking into it & that I must keep in touch with Col. Motharu.

I kept waiting for Anil behl & his reply. I again called him on 23th Dec asking about the development. He told me that he cannot explain me over phone as he was busy & told me to meet him. I told him that I was ready to come immediately. On this he told me that he was occupied. I asked him to meet on 24th or 25th, but he refused. he then confirmed me the time for 5:00 pm on 27th Dec like the timings given by Mukesh Yadav. Cleaverly, at 3:30 Pm again, Col Motharu called me informing that Anil behl had instructed him to call me & inform me that the meeting was not possible as both Col Motharu himself & P.K jain was unavailable. Col Motharu told me that he won’t be available even the next day & cannot confirm the status for any other day.

After this no efforts were done by him to contact me. On calling him, he told me that this has happened due to not attendance of the problem from day one & gave several other reasons like blockage in the drain pipes, due to excess rainfalls & even that women put their sanitary napkins in their flushes etc.could have resulted in such acute damage. I told him that this was not acceptable & he must get the resolved. He abruptly told me that he would see whatever he can do & told me that if I put pressure on him, he would leave it as it was. The flat remained in totally damaged condition till date.

I told him that I would handle the matter legally if that was not resolved to my satisfaction. He said that he is not moved & do not care about legalities. I even told him that I would ensure that I would take it to media & he told me that he do not care for them as well & do what I can do.

3) After this all my efforts to get in touch with him on his cell phone were unsuccessful & he has even stopped taking my phone calls.

Today, my representative called him to check the status of the flat & he misbehaved with him & told him that they have given the possession of the flat & that now they do not take any responsibility & only I would have to take the responsibility of the flat. Till date no reply has been given by them.

None of them is ready to give their email Ids & any details of the promoters/owners of Perfect facility.

Perfect facilities has been sending threat letters that the maintenance of the flat @ 2.29 per sq unit was unpaid & that if that was not paid, they would cut the water & electricity of my flat.

I am paying & EMI of Rs.48038 p.m & even after that I am unable to shift to my residence & I am not able to get my house furnished as I am not sure that when the house would get flooded because of the negligence of the Orchid Petal Project team & mayhem created by Perfect facility management.

I have lost my mental peace, my health & I am losing several thousand per month & this is causing business losses of several lacs.
