Non Payment of Credit Note

Hi,

I had booked a flat in Lotus Zing 3C project in Oct and was promised a commission payback of 1.25% and a credit note for the same was also issues by Investors Clinic stating that I will get the commission as soon as I make the first instalment to the builder since their funds will be released by the builder only after I make the initial payment to them. After paying for the first instalment when I approached Investors Clinic (their representative assigned to me), he claimed that the disbursement will have in two phases i.e. half of the commission I will get when I make the first two instalment to the builder and another half after I make the payment for the 4th Demand note from the builder. This was contrary to what was promised and written on the credit note. Anyways, I agreed and after making the initial two instalment, I approached the same representative and my nightmare started…….It took me almost 3 months to get the first half of the commission and with assurances that the other half I will get as soon as I pay for the 4th demand note from the builder. Now that I have already made payment for 6 instalment and it’s been 2 years that I was promised the commission would be paid, I am still running from pillar to post for the remaining amount. 99% of the times their representative will not take my calls or reply to my SMS, so I have to call him from different numbers of my friends and family, and when he picks up the phone, he is full of excuses like our directors and signing authority are out of country or your payment process is in progress or our director has resigned and we are waiting for the new director to join etc etc…….. Don’t they get their salaries when their directors are traveling?? If yes, then why not the customer get what is due to them. Also, signing authorities cannot be traveling abroad 3 -4 month at a stretch and if they have so much money to travel abroad for months why not pay the customers first and then enjoy their leisure trips.

Frankly speaking I had very good opinions about IC and actually had recommended them to lot of my friends and acquaintances, but now I feel that I have done extremely wrong for them since they will also be treated in the same manner by IC after their deal is closed. People from investors clinic will run after you and make 10 calls to you every day till such time that you close a deal and once it’s done it is going to be the other way round.

The IC representative that I am dealing with is Mr. Manoj Rajput. Am not sure whether it is his lethargy to get the process fast cycled or it is his limitation because of the inefficiency of the organisation for which he works i.e. Investors Clinic. Whatever the case, at the end of the day they are losing reputation, customers and business left, right and centre. I am shocked by the number of complaints against them in this forum.

I have even written to [email protected] and [email protected], let’s see if I get any assistance from them otherwise I will be left with no option but to approach consumer court.

I demand that I be paid what has been committed along with interest from the date the amount was due to be paid.

To conclude, I would strongly suggest&&&please do not go to Investors Clinic. If a company of this status cannot pay promised and committed money of just INR 10000 - 15000 to it’s customers, it is not even worth being in business for them. Looking at this scenario, where they are not able to pay a small amount of 10-15K for 2 years, it’s a strong indication that they might be going bankrupt.
