Network issues or handset selling techniques

I have a post paid mobile connection from last 5 years. I have a very strange problem with TATA indicom. My mobile shows "No Service" for entire day and shows full network strength at night around 11:00 PM till next morning 11:00 AM. I have visited TATA indicom showroom (True Value Hub) to fix the issue. They gave me in writing that the Nokia handset is faulty. They claim that they have lost of experience therefore need not check the handset. When i question, how does it work at night, they say it cannot.

After giving repeated complaints I decided to disconnect the connection and but TATA Indicom people wanted me to buy a new handset to fix the issue. I gave the disconnection request and now from last 2 days the mobile network is restored. The mobile works entire day without any issue. I am somehow feeling that TATA Indicom wants to sell handset by giving customer a problem in handset.

If this is the case then it is illegal activity. I am still not sure why this is happening. For time being I have canceled the request to disconnect the mobile connection.

I want Tata Indicom should look into this matter seriously instead of claiming handset problem (playing blame game).
