Not replacing

I had buy a car in October & my car battery is creating problem from Jan As the dealer is not putting proper water in battery in service.

Nov Today 15 Aug my battery is dead as per their saying And they are refuse for warranty as they are saying my car in driven more than 40000 kms & warranty laps after.

Kinldy suggest what i have to do As this is correct or not.
