Manufacturing defect in clitch

I have purchased a maruti zen estilo no.&MP04-CD-3043 from

satyam motars, bhopal. after few days i come to know that its clitch

is having some problem that it is not having "play" and pickup is not good. I have reported this on satyam motars on first servicing, with in a month from date of purchase. They told me that no problem, we are adjusting the clitch. But after servicing gears were become tighter and clitch was also not repaired. From then i am repeatedly complainting the same problem that clitch is week. Now they are telling replace the clitch by new one, this is the only solution. But this is manufacturing deffect. Please tell me what should i do?
