Defective cartridges not being replaced

I purchased HP cartridge worth Rs. 500 but when I opened the packet the cartrige was defective. The circuit chip was torn off. SO I couldnot use that and how to get it replaced? Another one I purchased a few months later, that one worked but now has stopped working, although the ink is there in that. I want both of these cartridges to be replaced.
