Deficiency in service and sale of defective product

Dear Sir,

this is in reference to the Blackberry Bold 9790 which i purchased on 14/12. The phone had the below problems from the very first day :

* The phone suddenly heats up and the battery from full strenght discharges to nil and the phone turns off.

* when put to charge, a clock comes up on the home screen and remains lighted till manual exit is made. (this does not happen in any other blackberry phone)

* The phone hangs while using the camera.

* The phone hangs.

And when i reported these problems in the service center on 27/1, all they had to say was, that since these problems are not recurring in nature they ll try for changing the battery and reload the software. They generated a job sheet (CAL/BB/11/06295) his regard but till date am yet to receive a word from their side.

Today while talking on the phone again it heated up and this time more than usual. It was so hot that i could a bake a cake on it. I seriously dont understand how a brand new phone can have software issues or battery issues that too the class of RIM. Hope the problem gets solved soon.
