Delay in replacement of bad mobile/refund

Hi, I got relacement certificate for HTC HERO I bought on 28 Feb 10. htc Complaint number is: RINSRS100407001 I went to the retailer "Mobile Store" in bangalore where I bought the phone from and I was told that they are out of stock and cannot help. I was given a dealer's number (9341258747), dealer also told me he does not have stock. My question is that whose responsibility is that I get the replacement asap. Is it HTC or the Mobile Store or the Dealer. I do not need the phone now. HTC has not given any date for replacement neither are ready to refund the money. Serial number of the mobile is: HT99FL903815.
