Poor nokia firmware

I had purchased nokia 5130 mobile on 6 th june..from that day my mobile"s operating syteam mean nokia firmware was crashed atleast 5 to 7 times ..till 1 year thy provide warranty so they update the software free.. but now they take money... this is manufacture defect so they should replace my phone...
