Refusing of WARRANTY

I brought a N8 in April.

Four month later I dropped it out on my home marble floor and ONLY THE GORILLA GLASS was broken. touch input and the LED display is perfectly working. May be its my bad luck and I dropped it by chance. I will not get any Warranty for the Gorilla Glass of course. I still using my N8 without any problem almost 3month after I broke gorilla glass. Now a days I encounters with a problem that my HEAD PHONE JACK IS NOT WORKING PROPERLY. Whenever I inserting the headphone and ply music/video I hard a very low Sound over my headset. I insert properly the 3.5mm jack and my other N-series head phones but nothing changes. the headphone is working properly on my N79.

When I submit my Phone over a Nokia care center, The told me that my warranty is now invalid as my gorilla Glass is broken. whatever the issue is efferent. My headphone socket was not working properly.

The told me to Pay and repair.

I never ask them to replace my gorilla glass as I know its a physical damage.

but the Refuse me to repaid my head phone socket which is under warranty.

Please suggest me now what to do.
