Faulty hand set Nokia E5

I lodged the complaint on 30-10-11. After lots of follow up with Croma they today finally said that the hand set has been replaced. To my shock the hand claimed as Replaced Set was a second hand and old set!!!

Without phone I am having lots of problem, its more than a month now and cannot waste time in chaseing Croma or Nokia, please advise Nokia to refund my money immediately. Its an expensive phone.
