Refund of Rs 5225.00 against cancellation of purchase

I am to say that I paid Rs5225.00 to ebay india via net paisapay on 11.5.09 for purchase of used Philips home theatre. Payment was made from ICICIBank Credit card 4477xxxxxxxx1009 by paisapay method on 11.5.09 in favour of ebay.in. The e bay stated that the item will be despatched to my address by 18.5.09orelse the amount will be refunded to buyer by 23.5.09. But so far no refund was made. I request to help me in getting a refund of Rs5225/- from ebay india as they did not despatch the item by due date.
