Forcible subscription of a charged service in my account

Dear Sir

I am a client of Tata-Indicom pre-paid mobile services, since Nov.

Recently, on 10th Sep I received a SMS on my mobile stating :

"You are successfully subscribed for Bible alerts on SMS. Charges Rs.30. Auto renewal after 30 days. To unsubscribe, sms UNSUB BIB to 582828."

Now I never ask for this service and it was activated on my mob. no. and Rs.30 were debited from my balance.

I sent an sms as mentioned above to unsubscribe the service and I received the response immediately stating :

"You are not subscribed to Bible. To subscribed SMS SUB BIB to 582820@Rs30/30days."

But the service was not disabled on my mobile and till then I am receiving the SMS Bible alerts everyday.

I tried to disable the service by sending the sms to unsubsribe for the second time and I receive message stating

"You are not subscribed for the service".

And I am still receiving the sms Bible alerts.

The customer care says the service is still active.

Following is response of customer care:

- The service is activated from my end.(THIS IS NOT TRUE)

- The deducted amount will not be refunded back.

- The service cannot be deactivated from their end. THIS MEANS THAT THE SERVICE WILL REMAIN ACTIVE AND THE AGAIN THE CHARGE WILL BE DEDUCTED FROM MY ACCOUNT, BECAUSE FROM MY END ALSO THE SERVICE IS NOT GETTING DISABLED, IN-SPITE OF MY SENDING THE SMS TO UNSUBSCRIBE THE SERVICE, IT IS NOT GETTING DISABLED.

I have been following-up with the customer care as well as the Tata Indicom's official, but they are reluctant to solve my problem. Every time I call them, they register a complaint and say it will be solved and close down the complaint at their end with the solution that “the amount will not be refunded”.

Following points should be noted regarding the reliability of the company's System maintaining the details of clients data.

1- They say as per their system, the service has been activated from my mobile by accessing some site, internet on my mobile. (BUT I AM USING A VERY OLD HANDSET WHICH IS VERY SIMPLE AND NOT HAVING ANY FACILITY OF ACCESSING INTERNET)

2- In-spite of my sending two sms to unsubscribe the service, the service is still active.(I AM GETTING THE RESPONSE FOR UNSUBSCRIBED SMS AS "THE SERVICE IS NOT ACTIVE"). BUT THE CUSTOMER CARE SAYS IT IS STILL ACTIVE AND I AM ALSO RECEIVING THE ALERTS.

Considering the above we can say that the system for maintaining the information of clients calls and other usage is not working properly and I have to suffer for unnecessarily.

My problem is :

- The service has been imposed on me forcibly by Tata-Indicom, it's charge has been debited from my account.

- I am not able to unsubscribe the service in-spite of sending the required sms to unsubscribe the service.

- Nor the customer- care, nor the company is solving the above mentioned problems.

The question is not of money, but the fraudulent practices being followed by Tata Indicom.

I hope your office will take serious note for such irregularities and ensure the customers are not harassed by the service providers and I look for your guidance and further action.
