Dear Mr. Gaurav,

Whatever you have put in seems to be logical at your end, but for me when I have paid November Installment as per my attachment which was given to you and sent in by your Customer Care Department for collecting the EMI. Your Customer Care Executive that time called me and told me (not remembering her name) that one of our executive will come to you and will give proper receipt for the amount collected.

Now please for God’s sake as I have other priorities in life and do not want to linger on with this issue, close it before 28th of this month before levying penalty on further delay in payment. Probe the receipt of November till today evening and give me the exact amount after deducting the November emi so that this issue is closed once for all and it should not reoccur again. This I feel is very disgusting from your esteemed organization not recognizing the payment made by the customer within the due dates. Now I have a question towards you, when as per your statement I have not deposited the November receipt why you have not raised the issue with me.

I am waiting for the final amount by today evening so that your authorized executive will collect the final cheque from me and will give me total clearance certificate which I actually requires. The suspicion came to my mind when I hear from you that the November receipt which I gave to you is not the real one.

Now if things will not get cleared before the 28th of this month (the date of penalty). I will be left with no option but to take my case to Consumer Court along with all the receipts and the correspondence which I am having with you and your other officials. Till such exigency appears, I want to act in a civilized manner for closing this issue.

We refer to your email dated January 17.

We would like to inform you that rate of interest on the easy cash loan can be increased under different marketing programs/promotions. The marketing promotions vary from time to time and any changes will be communicated by the bank to you.

We would like to clarify that we have notified all the customers in June and July statement regarding increase in rate of interest.

We would also like to clarify that the preclosure fee of 3% is debited systematically at the time of preclosure of easy cash loan.

Therefore, please accept our inability in reversing the same.

We would also like to like to express our inability in reversing the principal balance of loan.

We request you to make immediate payment of Rs. 8665.00 (3% preclosure charges included) and write back to us post which we will preclose the loan and will reverse remaining charges.

We would also like to inform you that as per our records we are not in receipt of cash payment of Rs. 2570.00 on November 25.

We have forwarded the copy of cash receipt to the concerned department to investigate the matter and we will revert to you shortly regarding the same.

How come you revise the interest rates without informing the client who is actually the sufferer. Even in Home Loan cases it is mandatory and legal obligation that if there is any revision in interest rates, they client should be informed in any way. Secondly you are not doing me any favour by putting the proposal of closure of 8381.84/- with 3 % closure charges. It is your problem. If by any means have I signed the document which is showing me that it is my duty to pay the extra interest rates whenever it is levied without informing, then I will pay. Secondly whatever was committed to me should be adhered otherwise things can go beyond control if you start blackmailing the client. Why am I going to pay 3% closure charges. If you are accepting to receive the committed charges, I am going to break this card in two pieces and courier it to you for its closure (The rule for destroying/discontinuing the credit card as claimed by the bank procedure). The rest will be decided by the Consumer Court. If they feel that I have cheated you, I will pay the penalty but If they feel otherwise, then I am going to charge the extra amount for harassing me.

I am attaching the November Premium which you have skipped in your excel sheet. I don’t know why but if I would not have retained the receipt, your bank would have told me that you have not paid at all.

Now when I have given you the November receipt also, my account is clear in all means of debit.

I would request you to check the account again and settle the matter for the closure.

We would like to inform you that the Easy cash loan for the amount of Rs.50, 000.00 was converted to the 24 months plan based on your request on 18/01

We would like to confirm that last EMI will be billed in the statement dated March 08.

Please note that the interest rate on your Easy Cash Loan stands revised, we would like to inform you that the bank has re-booked the remaining loan at a higher rate but keeping the EMI of the loan constant with increase in tenure.

We will like to clarify that the easy cash loan was offered to you at an emi of Rs. 2, 570.00. This formed the total amount due on your account. However since we did not receive the payment of the amount due, late payment fee has been levied resulting in an increase in the total amount due.

Since the subsequent payments have not satisfied the total amount due this has further lead to the levy of the late payment fee.

We would like to inform you that total outstanding on your loan account is Rs 16, 586.78 which is payable by you. However we request you to make the payment against the principal outstanding of Rs. 8, 381.84 along with 3 % pre closure charges and write back to us for the zeroisation of loan account.

Your cooperation and prompt attention to this matter will be greatly appreciated.

First of all I would like to thank you for the prompt reply you gave to my query. Secondly there is a bit of Communication gap that has cropped between your bank and me. As per your Bank Representative and Sanctioning Authority officials some two years back which had clearly told me that 1. The loan will be over in complete 2 years

2. The EMI will be 2570/-

These two commitments I have already fulfilled and as per my understanding there should not be any penny pending towards me after giving Jan’09 EMI. Now When I see your mail with the attached excel file, I was taken by surprise how that is possible. How come even after completing 2 years of payment am still holding 16586.78/- on my shoulders.

Why it is being done to a corporate customer who has without fail repayed all the amount due to him. Why is Bank bent upon charging hidden charges from me which no body from your bank at the time of disbursement of loan did not mention anything. Please put yourself in place of me, will you be paying the rest amount if it would have been charged to you. (I don’t think so.). Please get back to me with full fact and figures so that the need may arise that I may have to take the legal help. Secondly I have signed no documents that does not mean that you will screw me like anything and will charge any amount.

To my best of understanding was to pay monthly EMI 2570*24 = 61680 which includes the interest and other service charges on easy loan of rs. 50000/-

Please revert me so that the matter could be sorted out without any legal compliances.
