Excess billing and delay in refund

Dear Sir, Inspite of several reminders to HSBC regarding refund of excess amount paid, HSBC is still sending only bills for more amounts to pay. The last letter which I hv sent to HSBC is as per below:-

Your Ref: - Letter dt.04.07.2008

I am in receipt of your letter dated 04.07.2008 in response to the letter sent to Mr. Rajnish Bahl dt.03.06.2008.

At the outset, I fully disagree with your allegation that the payments were not made as per due date. While going thru the letter, I understood that, you have not referred my account properly or were misguided by your department. Again my repeated reminders to you remain unproductive towards redresal of this matter.

I have cleared all the dues before due dates which you can realize through the records. If any delay happened, I have duly paid the interest also. As a customer, I have one and only responsibility to drop the payments before dues dates and no way responsible to reach those payments at your hand unless and untill you close the drop box system. Your rule says to drop the cheques before due date which I have done and if you collected lately or delayed in entering in to your system doesn’t allow you to penalize the customer. Customer can only ask you to reverse the fees when you allegedly charge such fees to the credit card account and when you hesitate to do so, customer left with no option but to cancel the card. I hope you understand the situation at which all this inconvenience happened.

Under the circumstances you are therefore hereby called upon and required to pay me the said amount of Rs. 332/- as the principal amount together with interest thereon at 18% per annum from the date of the payment thereof latest within 7 days from the receipt hereof by you, it shall be deemed that in normal course of business. You are unable to pay your business debts and discharge your commercial liabilities and in such event of your failure to pay off the dues I shall be constrained to adopt legal proceedings against you under various sections such as criminal, cheating or by approaching Consumer court for the delay in returning the refund and/or sending reminders for paid dues.
