Refund on account of Travel in Lower Class

Before making the request, it is necessary to provide the following brief factual background for this claim.

Attached please find a copy of the e-ticket on which the passenger named therein had travelled on July 10 from Delhi to Jaynagar on Train No. 4650 (Saryu Yamuna Express).

You may appreciate that at the time of print-out of the reservation chart, the berth/ seat was confirmed as no. 11 in coach AB (i.e. an AC-2 tier coach) in the said train.

However, to our utter shock and surprise, when the train actually arrived on the platform in Delhi Junction on the said day of travel (i.e. July 10), we found that there was no AC-2 tier coach. Also, there was even no announcement to this effect and the passengers were made to suffer and search for the said coach (with all their heavy luggage) from start-to-end of the train at the odd hour in the night (as the train was delayed by more 3 hours from its scheduled arrival time), with no help from anyone.

After a lot of suffering and hue and cry, all the passengers (including passenger travelling on the attached ticket) having the confirmed AC-2 tier berths were accommodated in a lower class i.e. AC-3 tier.

If this was not enough, then the TTE also acted in a blunt manner and just refused to entertain any compliant from the passengers. He also refused to give anything in writing (including a certificate) to the effect that the passengers were made to travel in a lower class despite having the confirmed tickets for higher class citing the reason that the train has started from Amritsar and he has taken charge only from Delhi Junction and thus he does not have any authority to do that. He just continued to act in a blatant manner.

As the TTE was of no help, we approached the Station Master for lodging our complaint to this effect, wherein also we were made to run post and pillar and they initially refused to lodge our complaint. However, after a lot of insistence, and ascertaining our credentials as well as the validity of the complaint, the Station Master (Commercials) finally lodged the complaint. A copy of the said complaint is attached herewith for your reference.

The passengers tried their best till last station and from all TTE s whoever boarded the train in that particular coach and the station master at the de-boarding station for the issuance of certificate and refund of difference money, but of no use, as everyone just refused to entertain any such request, stating that no certificate can be given and money be refunded, as we have got e-tickets. They also said that if required, facts can be verified by the investigating body at any time from railway records.

The above has been stated to just give you a snapshot of the sufferings, which Indian Railways has left us to suffer. And this e-mail is just to request you (in view of the above) to assist us in getting the difference amount back asap.
