Super Annuation - A Classic Indian Case - Another Corporate Conundrum!

The fate of a guaranteed retirement plan of a UB Group Company through LIC of India…..

I have a very peculiar problem. I will give all details, by naming all involved, without suppressing or distorting anything.

My name is Stephen Jose and worked with Mangalore Chemicals & Fertilisers Ltd., for 20 continuous years since 1973. I had an excellent career with this joint sector Fertiliser Company, from the Greenfield stage, in their Marketing Division, and had the distinction of getting all my promotions, being the first among equals during my entire service with MCFL. I never had any blemish in my career history nor records to the contrary and the last position held was as Area Manager at Davengere, Karnataka, which I left by resigning consequent to getting a better assignment with M/s Nagarjuna Fertilisers & Chemicals Ltd., an upcoming Fertiliser company, then.

I resigned and left Mangalore Chemicals in October 1993, mainly due to two main reasons:

1. The company was not growing in any manner, even after the joint sector firm's controlling interests were taken over from the Govt. of Karnataka by the U.B.Group of Bangalore headed by Mr. Vijay Mallya, in the year 1990. The employee morale was getting poor due to the culture difference between a fertilizer company and a liquor group. The new promoters interests were also not clear, as they had no core competency in the field, and were more interested in other things other than nurturing and growing the acquired company.

2. The new Managing Director of the Company Late Shri N.B.Chandran a UB Group nominee for the Position, though a good professional and Technocrat was a peculiar character, otherwise. His earlier stint as the Managing Director of Fertilisers and Chemicals (FACT), Cochin, was also linked with various unusual and unprofessional activities, including various other inappropriate allegations including misappropriations. This person had a tiff with my brother, who was working under him in FACT, whose jurisdiction was in the Finance Portfolio, which given an option the MD wanted to bulldoze and misuse! In fact the sibling connection, I had with one of his erstwhile colleagues was not known to Shri N.B.Chandran during the tenure, of my working under him.

In the given scenario, when I got a better option, I resigned and had a proper release from the company after the due notice period and a send off was arranged, for me, which was chaired by none other than the same N.B.Chandran, after which the following happened.

1. I joined M/s Nagarjuna fertilizers and served the next 7 years and is on my own since the year 2000

2. Very shortly after I left MCFL Shri N.B. Chandran came to know about my connectivity with his erstwhile foe and made remarks in my file that all my dues accrued for the service of 20 years should be withheld. The remarks what he made in my files God only knows, other than the personnel dept and others privy to it, after my departure. I left with a proper relieving order and joined another reputed company in the same industry.

Subsequently through the legal route I obtained all my dues like PF Gratuity etc after the demise of Shri N.B. Chandran in the year 1997.

BUT the SUPER ANNUATION I am yet to get, as the rules relating to it is another ball game, and for which my various correspondences with the subsequent Managing Directors, of Mangalore Chemicals & Fertilisers, did not get any response till date.

In my relieving order there is the following note as regards Super Annuation is concerned " For the purpose of obtaining superannuation benefit it should be treated as premature Retirement. "

Can somebody suggest:

1. How I can proceed to get my retiral benefits including damages and costs as I have earned it, and it cannot be left to the whimsical behavior of Corporate Managers WHO have no concern for such things.

2. What is to be done to proceed on the defamation angle as the Chairman of this great Corporate entity, for the last near two decades, is none other than Dr. Vijay Mallya a member of the upper house of Indian Democracy, for a period of six years, who left to himself would aspire to become even the President of the country!
