Dear Sir,
I wish to submit following facts about the offence committed by M/s Nitishree Infrastructures Ltd. Noida, against me;
1. That M/s Nitishree had come out with number of lucrative false advertisements in 2006 with intent to commit fraud in all leading newspapers in Delhi and North India for allotment of freehold residential plots, villas, kothis and commercial plots at its upcoming township at Shouryapuram, NH-24. Also number of property dealers and marketing staff of M/s Nitishree had made to me numerous telephone calls for making investment in the said township. I met marketing staff of M/s Nitishree where they dishonestly induced me that the township will come very fast and possession of plots, villas, etc will be given by Dec I under the said inducement purchased a plot of 175 Sq Yard by paying booking amount in June.
2. That M/s Nitishree kept on advertising for the said township till early Feb’07. In Jan’07, I had received a letter from M/s Nitishree demanding additional payment towards provisional allotment of plot. I made additional payment in the good faith in Feb’07. However, they fraudulently allotted a plot to me and further deceived me that possession of plot will be handed over to me latest by Dec’08.
3. That recently when I visited the site at NH-24, to my utter surprise no construction activities have been started at the site. I thereafter contacted marketing staff of M/s Nitishree several times but did not get any suitable response by them as to when they will commence work at the site. Till today, no work has been commenced at NH-24 site and M/s Nitishree is not committing any time frame to give possession of the said plot to me. I had several meetings with officials of M/s Nitishree in last six months, where I requested to refund the amount I had paid to them as there seems to be no hope of getting plot in the near future. Officials of M/s Nitishree have flatly refused to refund the money paid by me on the pretext that company has no money to repay.
4. That M/s Nitishree has dishonestly misappropriated my aforesaid amount which was entrusted to it by me by deceiving and fraudulently inducing to pay the said amount to it. There are number of other investors like me who are victim of M/s Nitishree and some of them have already lodged FIR against them for this fraud and misappropriation of funds given by the investors.
I, therefore sincerely request to please register my complaint against Mr. Anil Jain, Managing Director, other directors and officers of M/s Nitishree for committing the offence of Cheating, Fraud, Criminal Breach of Trust and misappropriation of my amount.
