New handset 5800 faulty from Day One

I had purchased a new Nokia 5800 handset on 30th April 09 from Shreeji-Z-Planet 1 & 2, Ashvamegh Bldg, Ram Maruiti Road, Next to Wagholkar Hospital, Naupada, Thane (w) 400 602. From day one when I used to get a call the number was not displayed and the shopkeeper kept on telling me that you need to do the setting properly and when I took it to his shop also he said the same thing and later on phone his person Harish (9967989881) told that it was a software problem and I need to download it from the site. I did it but it still did not work and the phone was totally dead. I then took it to the Nokia Service Centre at FONE CITY 214-C, Sethna Building, Princess Street, Marine Lines, Mumbai. They took the custody of the mobile and gave me a service job sheet on 3rd June no. 572504867/090609/5. After two days they gave it back sayin it is working fine. I spoke to them and said the problem still exist but they said it will be fine a takes a couple of days for the software to settle and dont insert the memory card. But again I took the Nokia 5800 to them on 18th June 09 and they said they will be sending to Delhi and do the needful. They again gave it back and I faced the same problem and then they said again they will send it to Delhi on 24th June 09. Day before yesterday they called up saying they have received the same instrument back from Delhi. I had told them very clearly that I had paid Rs. 18, 800/- and am strugling with that mobile and I need a replacement. I had been to the shop from where I purchased and they say they can replace the handset only within 2 days. I told them but the problem was there and they had told me its a setting problem.

I spoke to the Bangalore Service Centre also and they say they dont have the right to replace and they will inform the higher up. Later when I called Bangalore office they said the Higher ups have not given any instruction for the replacement. I asked for their numbers or email ID which they dont. give.

Please advise how to go about the same.
