Faulty Mobile Set

I had purchased a Nokia Mobile Hand set (Model-6500 black) from AM Mobile Telecom Pvt. Ltd., Shop No.039B, The Metropolis Mall, Hiland Park, 1925, Chak Garia, Kolkata-700094, Ph. No.(033) 24367509, 40011246, Mobile-9836315300 on 05-05-09. But its a matter of pity that from the very first day I had been facing various problem regarding Battery and push button. From that day I had been informing so many times to particular shop. Once they changed the Battery but same problem is still remain. Now they advice to submit the Hand Set for servicing. But my question is why I submit the Set for servicing as the fault occurs from the very first day of my purchasing. It should be changed by new one. I had requested so many times for change the Hand Set but all my endevour was went in vain.

Please do the needful as early as possible so I get the New Hand set instead of faulty handset.
