Denying replacement under warranty

On 28.06.08 16No.s 26Ah 12V SMF batteries of Okaya Make were purchased from Kamal Electronics, Katni for Rs.37, 800/- through Okaya representative Mr Manoj Yadav. On delivery 2 Nos Batteries was found crack near terminal, which was informed immediately to Mr Manoj, Mr Abhay (Indore depot), as batteries were not in stock it was told that use these batteries later on when the stock is available it will be replaced. Regular telephonic reminders were given to both Kamal Electronics as well as Mr Manoj Yadav, but stating non availability no replacement was given.

On 03.03.09 2 more batteries went down which was immediatly informed to Mr Manoj as well as Kamal Electronics, personally as well as telephonically. Received same reply that at present batteries are not available in stock even in indore depot so will infrom on availability. On 24.04.09 we were informed about availability of batteries, when tried to hand over the batteries to M/s Kamal Electronics he refused to accept the same stating Okaya engineer will visit the site will inspect than if required will take the batteries for replacement. Okaya engineer Mr Sanjay Visited the site and declared 2 Nos. batteries faulty and took them with him stating that in few days replacement / credit note will be issues. After 10-15 days it was informed that batteries are lying in Indore depot and as soon as some material is despatched for indore new batteries will be sent. Local Area Manager Mr Rajiv Shrivastav also confirmed the same. After few weeks it was told that batteries are working on a load of 300watts whereas failing on 400watts hence should be treated as OK. When we requested that these batteries should work in UPS having other 14 batteries of same make & model another engineer was sent for testing where these batteries failed to work. Now Mr Tarun Nagpal country head & Mr Rohit country service head is giving explation that the warranty period is over hence we cannot help or give any replacement for the same. Please help as the problem of 2 batteries were reported on the very first day of purchase and 2 batteries on 03.03.09 which was well within the warranty period, delay was from okaya end hence replacement with new batteries should be given. As on date also batteries are lying with Okaya / Kamal Electronics.
