Shri Nitin Kalra,

On receipt of your claim intimation dated 26th June for the accident occured to your vehicle no. DL4CAA8097 on 25th June, we had deputed Shri S.N. Singh, Surveyor the same day, who closely inspected your accidental vehicle the vey next day on 27th June. We have since received his Survey Report dated 28th June. While making his assesment for the damaged parts, Shri S.N.Singh pointed out CNG pipelines fitted in your car which were found to have been removed from the car after the accident, since the nut, bolt and fitting of CNG indicated that it was removed recently. Further, it is also pointed out that the CNG kit is neither endforsed in the Registration Certificate nor in the policy of Insurance. Various photographs taken by Shri S.N. Singh of your vehicle also indicate that the vehicle was fitted with CNG.

As per Section 52 (1) of Motor Vehicles Act, 1988 - Alteration in Motor vehicle "No owner of a Motor vehicle shall so alter the vehicle that that the particulars contained in the Certificate of Registration are at variance with those originally specified by the manufacturer. Provided that where the owner of a Motor Vehicle makes modification of the engine or any part thereof, of a vehicle for facilitating its operation by different type of fuel or source of energy including battery, compressed natural gas, solar power, liquid petroleum gas or any other fuel or source of energy, by fitment of a conversion kit, such modification shall be carried out, subject to such conditions as may be prescribed."

As per your own acceptance, you had made an attempt to fit-in the CNG in your car after your first claim. Thus, we have the reason to believe upon the finding of Shri S.N. Singh, Surveyor, who has successfully proved by way of physically inspecting the vehicle as also the images of the insured vehicle. Further, it is also found that CNG kit is neither endorsed in the R/C nor in the Insurance Policy, which is a breach of the above proviso under the Motor Vehicle Act, 1988.

In view of the reason stated above, your claim is not tenable and hence hereby rejected, which please note.

Thanking you and assuring you of our services always.

Hi Sir,

This is to bring in your notice that my Vehicle No. is DL4CAA8097 Has meet with an accident and it is given on a workshop for repairing in which, A survey has been done by SN Singh (Survior) and he has not approved the claim because the CNG is fitted in the care.

This Vehicle was a second hand and CNG was already fitted in the car when i purchased this car i removed it before purchasing.

After the first claim of my car i tried to fit CNG in my car but was not working properly thats why i had removed the CNG but your survey team has captured the Strip which shows the CNG is fitted in my car but the fact is this that this strip was a part of previous efforts to fit CNG in my car.

Would request you to approve my claim.

Thanks & Regards

Nitin Kalra
