Payment of fine for delay in the credit of the amount wrongly debited in an ATM transaction

I have a saving Account at PNB, Pitampura having account No. 1710000101337095. On 30th June I tried to withdraw money from my ATM. The transaction was denied but amount was debited to my account. I lodged a complaint with the bank on the same day having a complaint no. 17510636. The amount was credited to my account but only after a delay of 43 days i.e. on the August 12.

As per RBI's notification dtd October 23 and February 11, the banks are required to reimburse to the customer wrongfully debited on account of failed ATM transactions within a maximum period of 12 working days from the date of customer complaint.

Due to non- complaince by the banks a further notification has been issued dtd July 17 which states that if the bank fails to re-credit the amount in the said period of 12 days as mentioned in the earlier notification then the bank will be liable to pay compensation of Rs. 100 per day to the aggrieved customer. It is further stated that the banks will have to credit the amount automatically without any claim from the customer.

The notification dtd July 17 is applicable for all the transactions which are pending on the said date. My complaint was pending on the date on which notification was issued. Therefore, the bank is liable to pay the compensation but the bank has not yet credited the amount of compensation to my account. Kindly resolve the matter ASAP.
