Lack of Maintenance

I am having a dispute with my building committee in my residential apartment in Kolkata. I am paying Maintenance but the committee is not maintaining the terrace due to which my flat which is on the top floor is completely damaged due to water seeping in the monsoons.

Building Maintenance is a Service for which we pay… hence we are Consumers. I wish to file a case against the committee under the Consumer Protection Act (INDIA) and request you to advise if my complaint will be trainable under this act.
