I have been implicated for under section 306/34IPC on the basis of fabricated suicide note submitted by complainant (Neelam Kumari) to railway police at jalandhar along with her complaint after passing the three days of death tragedy by train accident of her husband (Krishan Gopal). In her complaint she alleged our name Pardeep Kumar, Asha rani (my widow sister), and gagandeep khosla her son as accused same way mentioned in the suicide note what he submitted on the behalf of deceased after three days of tragedy instead of same day of incident. Now suicide note was found from the personnel possession of the deceased at the site of incident on dt-27-06-08.Names of accused stated in the suicide note donot reflect the personnel identity of person such as their family name or parents name or any resident address or their any origin or any relation to deceased.
When it was sent to FSL-body (Chandigarh) to compare the handwriting of note with the samples of handwriting submitted by the complainant. Then Director of FSL body objected the samples by stating in their first report under enquiry no-1989 (dt-26-09-08) that samples handwritings have been written by the involvement of more than one person and does not have undersigned signature of the deceased so as to confirm it is written by same who wrote suicide note. Also they requested to railway police in thier returned dispatch to resubmit the samples having admitted signature on handwritings collected from some recognised institute or govt department or Local bodies or police station or court. Upon receiving these instructions from FSL body (Chandigarh), police is unable to collect required undersigned samples from the complainant, but they collected more improved samples having undersigned signature of deceased under the matter from house of accused during search operation (Khanna talashi) and sent to FSL-Body in their second dispatch. This time FSL body showed their carelessness towards the sample of handwritings having under signed signature of deceased right below his handwriting which are collected as more genuine documents than earlier from the house of accused (Pardeep Kumar NRI). But this time FSL body considered in their analysis only those samples of handwritings which are earlier submitted by the complainant through police to whom they objected in their first report under enquiry no-1989 (dt-26-09-08) and were sent back to railway police jalandhar. FSL-Body didnot consider our sample of handwriting having undersigned by the deceased in the parameter of their analysis. They wrote positive report in the favour of handwriting sample sent by complainant similiar to suicide note where as against that having undersigned signature, they didnot write any comments. Later we sent to private lab of Forensic expert in patiala, who gave report that undersigned handwritten sample sent to FSL body is disimmiliar to the handwritten text of suicide note. Then we came to know that why FSL body didnot consider our undersigned samples which was sent officially through same police party as of complainant. We want a stern action against FSL body for thier negligance opinion toward the relvant genuine documents which has transparent comparable features as per their requirement. We want to sue a damarge suit against this harrasement and carelessness shown by FSL body to evaluate genuineness of dying declaration of deceased due to which our whole family structure has been collapsed. Our house has been locked and we are facing fatal charges by attending a court trial based upon this framed report of suicide note by FSL body (Chandigarh) under their letter ref-450/S/FSL/Pb/dt-04-11-08 for FIR no-65 originated under memo no-1249-CH (dt-10-10) from GRP-police station Jalandhar.
We want justifiy enquire to our case and the responsible bodies should be penalised and to bring under trial for clarification. Our report represented by private lab-NAVDEEP GUPTA (Forensic experts of Patiala)-Mobile no-94170-10429 having comparision report under their ref-W-188/Ludhiana (dt-25-07-08) should be consider to reinvestigate the matter of said dying declaration left by deceased (Krishan Gopal).
Main motto to frame this suicide note after passing of three days of death tragedy is to use as defensive tool by the legal heirs of the deceased against the accused to halt proceedings of the money embzellement charges of Rs 16-20 Lakhs which they are facing in Civil court of jalandhar as defendants and accused is plaintiff in that recovery suit.
