Unethical way of collecting Debts

I had used my ICICI Bank credit card in April for Rs.50, 000/-. After that due to some financial situation i pay monthly an amount of Rs.2500/- till November. After paying all these years the present balance due is Rs.46000/-. In i requested the bank to make this to EMI or give a personal loan so that i can repay all the dues monthly and close the dues. But the bank told if i want to close i need to pay 43000/- in one instalment to close this otherwise they can consider giving me 2 instalment and not more. Since i was not in a position to pay that much amount at that time, i continued paying only the regular payment of Rs.2500. Again in November as i was not in a job i requested the bank for the settlement of the dues. The bank again told me, i have to pay Rs.38, 000/- in a single payment for closing the same. Since this is also beyond my reach and i was also not in a position to pay the regular minimum dues also.

In january one of their collection agent came to my house asking for the same and i told him the same that i need 12 EMI or one time settlement of a reduced amount. The executive told me that his manager will call me and went. Afterwards there was no calls.

Subsequently the bank has created a lien against my credit card dues in my savings account and blocked the same.

In March end i got a call from one lady collection executive, i repeated the above then she connected me to her manager and whom after discussions told he will call back after confirming with his higher ups. In the meantime one of the collection agents, by name Mr. Venugopal came to my house and as I was not there he called my mobile and started talking very roughly as if I had absconded without updating my whereabouts with the bank & he found out my whereabout after much research & told me to meet him & pay the minimum dues immediately or he knows how to collect it from me. After I conveyed that I spoke to Mr. Kripa, he went back. Since I had a banking relationship with ICICI bank for more than 15 years (when it was Bank of Madura itself) & all my banking accounts, loan accounts, Credit cards & insurance/Demat account are with ICICI Bank, I update my phone number & addresses regularly as and when I change them for which I have an acknowledgement also. Again after a day on 26/03, Mr. Kripa called me and told that I have to pay in one or two EMI the principal due of Rs.36, 000/- immediately. I have told my inability for the same and told him that I can able to arrange a loan of Rs.20, 000/-, which I can remit if they are ready to settle my dues. Then after long discussions he told me he will put up a request for a settlement of Rs.30, 000 in 4 EMIs and based on that approval it can be discussed further.

On 28th March one Mr. Pradeep pathak from the bank called me and told that a request has come and asked me why the bank has to give a discount. He told me that previously the bank used to settle the disputes for higher discounted rates but now he cannot able to reduce beyond Rs.36000/-. Then I conveyed to him all my conversations & relationship till date with the bank and also requested him to check my record with the bank. He after checking told me that since I had not used the card after 2006 & paying an average amount of Rs.2200/- for the past 4 years he told me that he will reduce it to Rs.3- and the same needs to be paid in 3 EMIs. I once again told him that due to my present situation it is not possible to commit for that much of a huge monthly payment and requested for further reduction. He told me otherwise to pay the minimum amount due for which I told him clearly if I pay that then I will be forced to pay the same throughout my life. Then he told me to have a rethinking and reply back to him by giving his phone number and email ID or otherwise other actions will follow he told. That day also I was not in my house and I was outside. My wife and my 15 month old kid only were in the house. Within minutes after I spoke with Mr. Pradeep, the collection executive Mr. Venugopal went to my house and asked for the money to my wife. From there again Mr. Venugopal called my mobile and asked for Rs.36000 immediately. I told him that I am already in conversation with Mr. Pradeep and Mr. Kripa and he need not talk to me. He started shouting at me on top of his voice and told me till I pay he will not go from my house. I immediately tried to call Mr. Kripa & Mr. Pradeep. In the meantime Mr.venugopal continuosly tried my mobile continuously and also started shouting at my wife & kid who are alone. My wife called me and told that the person is shouting and abusing in the house and he has told that till we pay him he will not move from the place.

I immediately called once again Mr. Venugopal and told him that I am liable to ICICI Bank for my credit card dues and in no way my wife or my kid or concerned with the dues, and told him not to abuse them in my absence. Since I could not able to reach mr. pradeep, I tried Kripa and told that I will come in the evening near the bank call him & till such time Mr. Venugopal should not disturb the ladies or kid in the house. Also conveyed them that if the bank is going to use such measures for collection, I would rather pay it in the court of law. I told him that if they want they can take the matter legally and not in this unethical measures.

The after so much of request from their managers Mr. Venugopal left my house. In the evening I could able to reach near the bank by about 7.30 pm only. When I called Mr. Kripa he told me that he is in driving and will call me back in a few minutes. In a few minutes I got the call from Mr. Venugopal instead of Mr. Kripa and he started threatening me to pay minimum amount of 9500 or 36000 immediately or otherwise he will use his own ways to collect the same from me. I told him that I can’t pay the amount and I told him to come to the nearest police station the next day morning to meet me & do me whatever he wants. Also told him that he should not disturb my house members for the same. But the next day morning I waited for him for more than 2 hours and he didn’t turned up. I called his mobile, first 4 calls he told me that he was on his way and after that he never picked up my calls. Afterwards I called Mr. Kripa and told the same and requested him not to disturb my house members by sending somebody else.

After that time nobody has come to my house or no one has called me. Now after this bitter experience I have started closing all the relationship with ICICI Bank from all kinds of insurance accounts, bank and related accounts. As the same would have already been reported in CIBIL, I am sure that for another 10 year I am not eligible for any kind of loan from any bank.

But now I would like to close this credit card account some way and I cant afford to pay that much of an amount in full one shot. Please help in solving this issue.
