I was working as an office assistant at Dolna Day School from 01.04.2009. I resigned on 30.04.2010. I submitted my PF claim on 19.05.2010 at Kolkata Park Office along with form 19 & form 10C duly filled up by me and signed by my employer. They told me that it will take around 2 months to get the cheque. But after waiting upto 1st week of September I went to PF office at 44 Park Street, Kolkata to enquire that why my pf amount is still unpaid. The P.R.O told me to contact the concerned person at 7th floor, Gr.6. The concerned person's name is Mr. Suman. When I contacted with him, he told me that my claim was rejected and the claim form was returned to my ex-employer (i.e Dolna Day School, P-V C.I.T Scheme, K-III, Rash Behari Avenue, Kolkata-42, Kasba).
I asked him whether there was any mistake from my side or not. He told me that it was the fault of my employer. I have nothing to do about it. My school have to submit Form 5, 5A and 10. and they have to submit the original claim form along with the required documents again. When I asked him that why they did not send me a copy of the letter, he told me that "It was not my duty. Go and ask your employer, why they did not submit the documents timely." But when I contacted with the Donla Day School authority, they told me they submitted the documents in time. They also give the xerox copies of the receipt of form 5 and 10 which was received by PF office but they did not handed me over the original PF claim form.
When I again contacted with the PF office they told me clearly that unless my ex-employer submit the original form along with all the necessary documents they could do nothing.
Though it was not my fault, I am being harrased by the PF office citing peculiar excuses. I am confused what to do. Please help.
