SUMMARY OF COMPLAINT AGAINST LOUGHBOROUGH UNIVERSITY

Applicant Student: N A B –

SUMMARY and CHRONOLOGY OF EVENTS:

1. Student (Neeraj) applies for a place in Postgraduate Master’s course

at Loughborough University (LU). (July)

2. LU makes a conditional offer of a place. (24-08).

3. Parent pays £3795.00 deposit towards fees. (26-08)

4. LU accepts the deposit. This is good-faith, earnest monies paid in the event of a successful entry to LU. During LU’s acceptance of fees, Ian Daykin of LU Finance even promises a refund sic. “If for some reason Neeraj does not come to the University we will do you a refund”. (26-08).

5. 1 September LU CANCELS Neeraj’s APPLICATION. Charlotte Ramshaw of LU confirms “Unfortunately we have withdrawn your application as you did not meet the conditions of our offer. We’re sorry to bring this disappointing news to you... “(16-09)

6. Since this time, LU made excuses and delays to process and make the refund.

7. After more than 20 weeks of delays, LU promises to make a refund EXCEPT £250.00 retained as “administration fee”. (12-01)

8. The only “administration” performed by LU was that of mis-administration and being guilty of deliberate and possible illegal misappropriation of £3795.00 for more than 20 weeks. For 20 weeks LU merely enjoyed BENEFIT of £3795.00 while DENYING us free and rightful use of our funds as we faced financial difficulties to meet fees and expenses for an alternative Post Graduate studies at University of Central Lancashire. Neeraj was simply allowed into the door, we made a good faith payment, LU showed him the door and then SUMMARILY HELD-ON to the money. A simple process MAKING of A REFUND is NOT ROCKET SCIENCE.

Through investigation and due diligence, Loughborough University may be found guilty and liable by failing to abide by relevant LEGAL obligations and requirements of :

1 The Consumer Protection Act 1987;

2 Unfair Trading Regulations 2008;

3 The Consumer Protection (Distance Selling) Regulations implemented into English law under the main provisions of Directive 97/7/EC of the European Parliament and the Council of 20 May 1997.
