Key pad nad track ball is not working

I have purchased two Micromax Q5 mobile phones from Gorakhpur. After using for 4months the track ball and key pad is not working at all. And i went to a micromax service centre in Gorakhpur and gave both mobiles to their hand. And it has been with them for almost 15 days. Still it is with them and they neither repaired nor return to us. so what we need to do now?

Do we need to aproach toa court or what else?
