Warranty Problem

I have purchased 2 No’s Amron INV 080H29R with Sr. No. 1501066249425 / 1501066254881 for my APC inverter (Model: - BI900I) which is installed at my office. Ever since the second month from the date of purchase I have been facing problems regarding the backup time. I had brought the same to the notice of Amaron Dealer in Kolhapur.

On April 12th the dealer whom I had purchased the battries had taken both the batteries for charging and stated that the APC Inverter is having a problem and is not charging the batteries properly. That very day I lodged a complaint to APC and their engineer specifically checked the Inverter and replaced it immediately with a report of charging problem. After a few months I started having the same problem and after checked with Amaron engineer, the first battery bearing Sr. No. 1501066249425 was replaced with 1501346678277, then later after a few months the battery with Sr. No. 1501346678277 was then replaced by Sr. No. 1501027551745. Then on January 24th battery Sr. No. 1501066254881 was replaced with battery Sr. No. 1501027551745.By this time I was frustrated and I called both the concerned engineers and asked them to solve the problem. Then the Amaron engineer found that the battery with Sr. No. 1501346678277 was defective and was replaced with a new battery bearing Sr. No. 1501117923289. In the month of August I registered another complaint to the local dealer and confirmed the same with the Supplier from whom I have purchased the Inverter along with the batteries that I am facing the same problems.

My complaint was ignored until January where after calling them I get an report that both the batteries are damaged and have to be replaced. I had also met the Amararaja Engineer of the Pune Branch when he had visited Kolhapur and explained the same to him. He then convinces me that he will look into the matter and check with the warranty details etc... The Local Dealer, Kolhapur asked me to pay Rs. 8000/- (Eight Thousand Only) by which they could replace both the batteries under pro-rata terms. I was not convinced because since I have invested in purchasing Amaron Batteries, I expect at least 2 years of trouble free batteries. Hence I insist on free replacement of both the faulty batteries.

As by now my office inverter would not even give me a backup of 20 Minutes. Then after speaking to the Local Dealer, I was convinced by the owner that until the case is solved by Amaron Batteries we will supply new batteries by which I paid him Rs. 8000/- (Eight Thousand Only) by cheque no. 097405 Dated March 25th and when the case is cleared the money would be refunded back to me. Today after contacting the local dealer & Amarraja Service person I get a reply that I have accepted the batteries on Pro-rata terms. All I could say that I haven’t signed any of the Job reports nor received any documents regarding the same from power Point in reference to the pro-rata replacements, all I was given is a D.C. No. 70 Dated March 20th for the supply of 2 No’s Amaron IN-080 (Sr. No. 1501018119068 / 1501507953070) and since I have been cheated by this type of after sales service I have no other way but to proceed to the consumer court for justice.

Once Again I request you to please look into the matter and please do not force me to take legal advice in this regard and if I am forced to do so, it will be totally at your risk, costs and consequences which please note.
