I contacted Mr. B.V. Unnithan, the Regional Manager of the Black Cats on my friend's during January. Black Cats is dealing with Photocopier Sales & Service. Mr. B.V. Unnithan introduced himself and briefed about his company and the services provided to various clients in and around Chennai. The way he expressed is Professional and I thought this organisation may be a professional one and I thought of availing their services, since I am also having Photocopier Machines with me.
In this connection, Mr. Unnithan informed to Mr. J. Sam David and sent during the month of February two service engineers to look after my photocopier machines for service. At that time I was having 1) CANNON IR-400, 2) CANNON IR-6000, CANNON IR-6020 4) CANNON COLOUR C3200. All are Photocopier machines. Initial service was good.
Since those people are in this line, I thought of purchasing A0 Plotter from Black Cats. In this connection, I negotiated with Mr. Unnithan about the same and it has been decided that one RC machine, to perform SCAN, COPY & PRINT working in a very good condition with One year Warranty will be supplied by them for a price of Rupees Four Lakhs.
For this financial needs I already approached Indian Overseas Bank, Gowrivakkam Branch for a Purchase Loan of Rupees Three Lakhs and I decided to invest Rupees One Lakh.
1. Black Cats issued me Proforma Invoice / Quotation for SCAN, COPY AND PRINT on 24-03 for an amount of Rupees Four Lakhs. This machine is suppose to perform the tasks of (a) SCAN AND STORE THE IMAGE IN COMPUTER (b) COPY AN IMAGE AND PRINT IN A PLAIN PAPER (c) PRINT A FILE FROM A COMPUTER.
2. Black Cats issed me ORDER FORM for the above on 25-03.
3. Based on the Proforma Invoice I have taken a loan of Rs.3, 00, 000/- from IOB by DD in favour of BLACK CATS and handed over the same on 25-03. The DD No. is 631087557.
4. On 26-03 BLACK CATS issued me a thanks letter and acceptance letter of Rs.3, 00, 000/- and informed that the machine will be supplied to the entire satisfaction of mine.
5. On 31-03 Invoice for Rs.4, 04, 000/- (instead of Rs.4, 00, 000/-) was issued, an excess amount of Rs.4, 000/- was collected from me, intentionally against the Four Lakhs. Still I kept quiet.
6. On 15-04 I issued a IOB cheque for Rs.50, 000/- by Cheque No. 880442 dated 15-04.
7. On 17-05 I issued a STATE BANK OF INDIA cheque for Rs.50, 000/- by Cheque No.266219 dated 17-05.
8. On 03-04 I paid Rs.4, 000/- by Cash.
9. Thus I fully paid the entire amount of Rs.4, 04, 000/- to BLACK CATS.
10. The OCE 9400 II Machine was supplied to me during the month of JUNE after a gap of almost 3 months. Demonstrations for (a) COPY AN IMAGE FROM A PAPER, what we will call normally as XEROX, (b) Printing from a Machine. However SCANING AND STORING THE IMAGE WAS NOT DEMONSTRATED TO ME. It was installed, then problems solving, etc., has taken almost about one month.
11. The machine is ready for use only from JULY onwards by us. However, the copies are not clear. Quality of the Xerox is not good. The same has been communicated to Mr. J. SAM DAVID.
12. Black Cats Chief Executive Mr. J. SAM DAVID promised over phone during July that he will supply freely a new drum for OCE 9400II which is costing Rs.57, 000/-, over and above the drum which has come along with the machine.
13. Black Cats Regional Manager also confirmed me over phone the same.
14. Upto November no new drum has been supplied to me.
15. During November I asked Black Cats about the new drum. Initially, Mr. J. SAM DAVID informed that there is no commitment about the free supply of drum from his end over phone. I have taken up this matter with Mr. Unnithan and Mr. Unnithan informed to Mr. J. SAM DAVID that BLACK CATS committed to COMPUTER SKILL for the supply of NEW DRUM for the OCE MACHINE supplied by them.
16. In the meantime, the quality of the SERVICE ENGINEERS are not upto the acceptable level. The Service Engineers of Black Cats used to damage the existing PHOTO COPIER MACHINES of mine under Annual Maintenance Contract with them, rather than rectifying the defects. I incurred heavy price to bring back my PHOTO COPIER MACHINES TO NORMAL FUNCTIONG and hence I stopped his SERVICE PART WITH OTHER MACHINES. However, I paid Rs.16, 000/- as AMC Amount to Black Cats, but haven't availed proper support because of his inefficient, incapable service, rude behaviour, arogent replies and cheating mentality.
17. Only OCE 9400II since it is newly purchased and under warranty, loan is taken from the Bank is attended by BLACK CATS.
18. Thereafter Mr. SAM DAVID agreed to supply the new drum for OCE Machine during the 4th Week of November but not supplied.
19. Mr. Unnithan, the Regional Manager, visited on January 4 and had a telephonic talk with Mr. SAM DAVID and after that he has informed that the DRUM will be supplied before January 20.
20. Upto January 31 the DRUM was not supplied.
21. I started writing letter to Mr. J. SAM DAVID to remind about his commitment and requested him to supply me the NEW DRUM FOR OCE 9400 II.
22. I wrote letters to him on January 31, February 18.
23. Mr. J. SAM DAVID replied on February 25 committing in writting the supply of DRUM for the OCE 9400 Machine, but when is not mentioned. In his letter he has mentioned that he has placed order with Importer and he will supply me the new drum as soon as the same is received.
24. Since the New Drum was not received by me and I am incurring a heavy loss, I wrote again a letter on March 8 in connection with the supply of new drum and requested him to supply me the drum at the earliest.
25. Thereafter after a long gap, on June 7, Mr. SAM DAVID sent three Service Engineers to check the OCE Machine. One service engineer is from the Original Supplier and the other two are from Black Cats. They have looked into the machine and infromed that the drum and blade for the machine has to be changed and then only the copies can be clearly come.
26. After the Engineers inspection, again I wrote a letter on JUNE 8 to SAM DAVID, requesting to deliver the NEW DRUM to OCE Machine immediately.
27. Thereafter no communication from him in connection with the NEW DRUM.
28. I am continuously following with Mr. Unnithan, the Regional Manager to whom I paid the entire money for the DRUM.
29. Mr. Unnithan used to tell me that "the drum has come, Mr. Sam had gone to collect the same"... like this right from November onwards.
30. The NEW DRUM HAS NOT BEEN SUPPLIED TO ME UPTO 20-06.
31. THE OCE 9400 Machine is not used right from NOVEMBER onwards, since the quality of copy is very bad and the quality can be improved only after replacing the NEW DRUM AND BLADE. SINCE THE MACHINE IS UNDER WARRANTY, BLACK CATS IS DUTY BOUND TO SUPPLY ME THE DRUM AND BLADE FREELY. HOWEVER, I HAVE BEEN ASKED VERBALLY TO PAY RS.12, 000/- WHICH I STRIGHTAWAY REFUSED & REJECTED.
32. Finally, on 21-10 a drum and Blade has been supplied to me. However the drum is not given to me as free as stated and committed. I argued that a new drum is suppose to be given to me and not as replacement. In this connection I have been told that If I am not permitted to take take back the existing drum, then they will not install the drum & blade which was brought on 21-10. To be frank, the drum brought on 21-06 is not at all new. BLACK CATS FULLY CHEATED ME.
33. I am unable to generate any revenue from OCE 9400 machine right from November onwards till 21-06.
34. Whenever, I am complaining about machines to the Owner he is getting angry and talks with very high tone.
35. Even today the OCE 9400 Machine is not at all working properly, no support given by SAM DAVID. SAM DAVID HAS CHEATED ME. Scanning of Image to Computer what we usually call it as SCANNER is not at all supplied to me by BLACK CATS.
36. I UNDERSTAND THAT HE IS EX-CID OFFICER AND OF THE OPINION THAT HE CAN DO ANYTHING AND EVERYTHING INCLUDING MANIUPULATING / CREATING EVIDENCES THAT SUITS HIM.
37. I am suffering a lot, since 4 lakhs is not a small amount. He should be penalaised. No mercy should be shown on him. Whatsoever may be the influence he may bring, the crime of him deserves punishment and I am confident that we must render punishment and appropriate compensation need to be claimed from him.
Request your kind help and appropriate action against Mr. SAM DAVID in this regard.
