Non delivery of product even if after paying aof advance an non refund of advance

Iam Major satyabrata swain. Iam a Major in the INDIAN ARMY and presently posted in college of military engineering located at dapodi. E ZONE located at chinchwad near ICICI bank close to BIG CINEMAS is a Franchisee appointed by the SONY INDIA PVT LTD to sell its products. SONY PVT LTD is a Company dealing in the sale and manufacturing of Electronics and other products.

2. I was interested in purchasing a home theatre model no DAVZ-777 sony hometheatre (hereinafter for brevity sake referred to as " the said commodity"). I taking into consideration both of the companies reputation and goodwill, decided on approaching E ZONE and purchasing the said commodity manufactured by SONY PVT LTD from my hard earned income.

3. On 29.10.08 i approached E ZONE and thereby enquired the price of the said commodity. E ZONE quoted the price of the same as Rs. 24, 300/- inclusive of all the other expenses/ taxes. Considering the offer being genuine, i agreed to purchase the same from them.

4. In lieu of the same, i paid an amount of Rs.2, 500 (Rupees Two Thousand Five Hundred Only) towards the Advance of the purchase of the said commodity. The receipt of which they accepted and acknowledged by issuing an Advance Receipt bearing number 2043001797.

5. I had put forth to the representatives of E ZONE that i would be taking delivery of the same at a later date i.e. on or before 31st of December'2008.the rep of E ZONE did not raise any objection nor laid down any terms before me for the same. They even did not put forth any specific terms that any additional amount would be required to be paid by me if the delivery is taken at a later stage.

6. On 21st December i approached E ZONE and requested them to deliver the said commodity. However the representative of E ZONE under the pretext that the same was not packed, asked me to come at a later stage. Hence i again approached No.1 of you on the 28th of December'2008 requesting the representatives of E ZONE to hand over the said commodity.

To my utter shock and disbelief the representative of E ZONE blatantly stated that the price of the said commodity had risen in view of which i was liable to pay a further amount of Rs.5, 600/- towards the same..I requested the representatives and reiterated the fact that Iam not bound to pay any such higher amount to them and am only liable to pay the agreed amount. I also stated the fact that time and again I approached the representative of E ZONE. However the same was to no avail. Inspite of various discussions between them and me they still failed to hand over the said commodity to me.

8. I even wish to further state that i even approached SONY PVT LTD though they agreed that E ZONE is bound to provide the said commodity at the same decided rate and not at the risen rate. E ZONE is not taking the grievance into account and is trying to show its supremacy as a future group enterprise to me which is uncalled for and shows sheer negligence and deficiency of services not at all taking into account the harassment caused to the consumer which is quite unheard of in today's consumer friendly market. On one hand the future group enterprise is trying to attract the consumers with various offers and things like happiness mela whereas on the other hand it is trying to ridicule the whole system and rights of basic consumerism in this country.

9. The said attitude of E ZONE is uncalled for. E ZONE ought to have provided me the said commodity at the agreed rate as they had taken the advance amount from me. Once the advance is taken from someone for a product it is supposed to be sold to them and it is against the ethics of modern day consumerism to harass a consumer in the manner they have harassed me. Iam disappointed by the unflustered attitude that E ZONE and SONY INDIA PVT LTD have shown to this serious grievance of mine. E ZONE is holding me in ransom and forcing me to pay the higher rate for the said commodity which is uncalled for and against the ethics of modern day consumerism being breach of contract and faith and trust which a consumer poses on the dealer as well as the company whose products are sold by these dealers.

The attitude of carelessness and unconcern can be seen from the fact that they have still not returned the above said advance amount till date and causing great mental harassment and financial losses to me. This is the sort of treatment meted to an army man who expects some amount of respect, help and concern from his fellow countrymen for whom he gives his life on the border being responsible for external security of his country but also is present when there is an internal security issue as in the case of Mumbai blasts and his fellow countrymen beckon for him. Both E ZONE and SONY INDIA PVT LTD are not concerned with the harassment caused to me due to the above said acts and further do not care of customer satisfaction which is uncalled for.

The said act of E ZONE amounts to deficiency in service as also negligence as well as breach of faith and trust bestowed upon them by me.it might as well happen with any other customer who would have the bad luck of interacting with E ZONE chinchwad. They are bound to provide me the said commodity at the agreed rates and are also bound to compensate me towards the unnecessary harassment caused to me. If nothing else they are at least supposed to return me back the money I paid them in advance.
