Defective laptop

On 15 oct I purchased HP Compaq 610 V model laptop from Home Town, Rajarhat, Kolkata, West Bengal-700156 (cash memo number-T69/39). Details of laptop are as under:

When I purchased the laptop it was a festival season and when I asked to check the laptop which was in sealed package I was told by salesman Mr Gopal (Mr Abhik roy chowdhary the Departmental manager was also present) that there is no need to worry and in case of problem they were there to help.

On 21/22nd Oct 09 I found the battery indicator showing only 95-97% charging and the indicator showing “plug in, not charging”. I took the laptop to home town shopping mall and intimated the problem. Mr Abhik (Departmental Manager) and one of the salesman convinced me that it was programmed by the company itself like that and need not worry. He also told me that since no service engineer is available in home town I should show the laptop to service centre because there duty/responsibility was upto selling the item only. When I told that it was there duty to deliver the item after proper checking by consumer only then I was told that I should have checked it and the whole blame was put on me.(Even though I had not checked the laptop in good faith as per request of salesman gopal (as there was rush in the mall on that day)

On 31st oct 09 I tried to run the CD given with a sony camera but it could not be read by the drive. Same CD was running in other laptop. On 2nd Nov 09 I went to service centre at Kolkata where the engineer also checked the drive and found it defective and kept there for 4-5 days for checking and repair.

On 4th Nov 09 I received a call from HP service centre that the DVD drive is defective and it requires replacement for which they had sent demand to chennai and same will be replaced on arrival which will take minimum 7 days.

Now this information from HP service centre is a proof that the laptop was defective and had it been allowed to check that would have been replaced by ezone there and then only. It is my humble request that this laptop be replaced by a new one.
