Subject: Sale of Defective HTC Touch Mobile vide

Invoice No. 301101883 dated 10.08.2008 issued by Hot Spot Retails Ltd

Dear Sir,

I had purchased one HTC Touch Mobile from M/s Hot Spot Retails Ltd., Pitam Pura vide above noted Invoice issued by them (Copy of the Invoice and that of details on the box are enclosed for your ready reference)..

Immediately after purchase of the said mobile I had to go out of Delhi for about 10 days. During this period I found that the Key Pad of my mobile was not functioning properly.

Since I was not in Delhi I could contact the dealer M/s Hot Spot Retails Ltd only on 27.08.08 but the dealer expressed his inability to help me for anything and told me that After Sales Service is the sole responsibility of the company. They advised me to contact the Pitam Pura Service Centre of HTC.

I visited the Service Centre next day i.e. on 28.08.08. The mobile was done some repairs (not known to me) and handed over to me.

To my utter shock and surprise the mobile once again developed same problem the same day i.e. on 28.08.08. Next morning i.e. on 29.08.08, I again went to your Pitam Pura Service Centre and the center people repeated the same process of repairs (details of which were not disclosed to me) and handed over the set to me.

Today i.e. on 31.08.08 the key pad of the mobile has developed the same problem once again.

I am an awfully busy professional and its just not possible and feasible for me to keep visiting the dealer or the service center on daily basis.

From the above, I am of the concerted view that I have been sold a defective mobile having a manufacturing defect ever since it was sold to me. Through this act of the concerned parties I feel cheated.

I, therefore, call upon you and all concerned to replace my above said mobile with a fresh piece within 10 days of the receipt of this communication.

If nothing is heard from you within the above said period of 10 days, I will be left with no option but to take up the matter with Competent Consumer Forum and other agencies for redressal of my genuine grievances.
