Unjustified holding of salary dues by New Delhi Institute of Management

Dear Sirs,

I would like to submit that I am an LL.B and Company Secretary by profession and I was offered the post of Manager-Operations in New Delhi Institute of Management and after rejecting their offer two times (due to inability of the Institute to provide proper job profile), I finally agreed to join the Organisation on 24th November on the condition that I will look after and regulate the operations of the Institute i.e. framing new policies for the Institute relating to admission of the students, Looking after the Legal matters & statutory Compliances of the Society, Holding Board Meetings, Preparing Minutes of the Society as well as the Institute. This way, I had to be responsible for hard core operations of the Institute & Society therein.

But after joining the institute, I was compelled to do the works like tele-calling, selling prospectus, booking Train Tickets/ Hotels, writing addresses on the envelopes only which were complete humiliation to my profession. Furthermore my employer forced me not to leave the office till 9-10 p.m. in the evening until I complete all hotel bookings all over India in which job I am not supposed to be an experienced one.

The kind of Job which I was compelled to do caused me great frustration and I felt tortured which I never felt during the entire three year working period.

Having felt sick due to the above reasons, I gave leave application and went on leave to my home town so as to revive myself from such trauma but as my self- respect didn't allow me to re-join, I sent my resignation Letter on 5th of December Under Certificate of Posting in which I gave one month notice for resignation and I mentioned that my resignation will be effective with effect from 15th of January. This was strictly in compliance with the service rules of the Institute which states that if the employee resigns, He/She will give one month notice and if He/She fails to give one month notice, one month salary shall be paid by the employee.

I returned on the Job on 1st January and as per the resignation notice, I continued upto 14th January which was more than the notice period required by New Delhi Institute of Management.

But when the time came for clearing my salary dues by the Institute, It didn’t clear my dues; rather they sent me a letter mentioning that I have not served the proper notice for resignation and that one month salary will be deducted from my salary.

I have sufficient evidence as to the serving of proper notice to New Delhi Institute of Management and still they are adopting unjustified means to hold my salary dues.

Besides that, my conscience did not allow me to adopt unethical means to persuade the students to take admission in the Institute as per the Institute’s practice.

I, therefore request you to put my submission to the Media so as to open the real face of this Institute.

My real intention to put this matter here is – How long will a common man suffer from this “unjustified exploitation” from his employer.
