Hacking of mobile and fradulent ISD Calls

Sir

My mobile is being hacked and someone (still untraced) has done ISD calls for the amount of Rs 13, 500.Without my knowledge and the LOG is also there in my mobile, on enquing from the company it is being said that some website has hacked the mobile set Nokia N 70 and they hae done it. Now why should I pay the bills for the wrong and what are the legal remedies available for the same. Pl advice
