SMS Spam from BPL Mobile No

This is a complaint against Airtel and BPL Mobile.

I have been receiving a promo SMS from 919773300000 from 16:20 hrs, 16th Dec. I received 62 sms till 21:00 hrs. I called up Airtel customer service, who said that I need to register under DND and the number will be blocked in "45" days. I called up BPL Mobile customer service, who confirmed that the number was a BPL number but said they cannot stop it.

I am still receiving smses. They started again from 12 noon and I have 14 smses already.

I want to take both these parties to court, can you guide me. Unfortunately I am not able to figure out the owner of the number else I would have lodged an FIR.
