This has reference to the allotment of the above mentioned flat to the undersigned in your BDI SUNSHINE CITY BHIWADI
Regret to intimate you that it has been more than 75 days that the registration of the same has been done at Bhiwadi sub Registrar but we are still to get the possession.
We were told at the time of registry that it will take between 30 - 45 Days, after 30 days we checked and we were told it will take another 10-15 days by Mr. Pankaj.
When we checked with him after 45 days, Mr. Pankaj again told us that it will take another 10 days, after taking confirmation from the site people.
It has been like that continuously and we have spoken to Mr. ahmed, Mr. Verma, mr. Pankaj, Mr. Amritpal, Mr. Sachin etc.
We are yet to get the possession, even after 75 days of paying the amount in full. Today only we checked with your Mr. Amrit Pal and he said that there was some leakage in the apartment, and we have replastered it, but it will take 3-4 days to dry, you can come and take the possession if you want. It will dry out in 3-4 days. When I asked him what would happen in case the leakage is still there after we take the possession and we move in with our bag and baggage, he had no answer. And those 3-4 days is also subject to condition that it does not rain.
Dear Sir, Every paisa of our money is hard earned money, we have paid the amount in full, and we will take the possession only when we are in a position to move in, without any hindrance of any kind.
We have already paid the full amount and nothing is pending from our side. We even paid some interest on delayed payments.
I have a few questions :
1) Why are we given false commitments again and again and again? Give us a firm date, let us say, an year from now. we will not bother you for an year. But give us a firm date.
2) We have entered into a business agreement, and as per that, I am supposed to give you construction linked payment, and once I have cleared all my payments, you have to give me possession. In case flat is not ready, you cannot take money from me. In case I don’t pay by the dates given as per your construction linked plan, you can charge interest (Which you have). In case either of the party defaulting, interest is to be levied, which you have very correctly taken from me.
Now we want the interest for the delay that we are being subjected to. Request you to give us interest on the total amount that we have paid to you, for the days that you are delaying the possession of our flat & let us know when we can get the possession of our flat. (We will only take the possession of complete flat, in moveable condition only).
