Non return of money 5150

I had taken a house on rent with help of Ashok Kumar real estate agent (M/S jai durga associate)

The rent was fixed at 10300/- on stamp paper for october. My employer company pays 50% of one month rent as brokerage which was ageed with Mr. Ashok Kumar by cheque. The processing takes atleast one month for the cheque to be issued. Ashok requested me to pay in cash in a week after the deal. I paid him the amount in cash. He ageed to return the amount when he encashes the cheque. He received and encahed the cheque after one and half months (approx.). When I came to know this from my employer I contacted him and asked to return the cash money. He has not returned the money after repeated requests. On phone he always says he is not having money now or he is not available. One and half years have passed but in vain.

I don't know what to do now.
