Sir/Madam,
Under the instruction of my client, Sri Dhiraj Kumar, S/o Sri Kameshwari Saran, resident of Manda Bagicha, Harihar Singh Road, Morabadi, P.O. & P.S.-Bariyatu, District-Ranchi, I do hereby serving upon you the following notice:-
1. That, my client had booked 2BHK flat, Unit No.-504, Block/Tower No.-13, measuring super built up area 1075sq.ft. in Sector-I, at Khelgaon, Hotwar, Ranchi.
2. That, my client booked the above said flat under “Rental Scheme Agreement for Allottees at NGHC, Khelgaon, Ranchi”.
3. That, the agreement (Para-2 of this notice) had came to in force on 29th October between M/S NCC URBAN INFRASTRUCTURE LIMITED (DEVELOPER) AND DHIRAJ KUMAR (my client)
4. That, Developer had guaranteed to pay Rs. 8, 500/- (Rupees eight thousand five hundred) only, monthly rent to its allottee on or before 7th of every month for the preceding month against the booked 2 BHK flat/unit till handing over the said unit.
5. That, my client is entitled to get the monthly rent (Rs. 8, 500/-)per month with respect to clause 6 & 8 of Rental Scheme Agreement till the getting possession of the said unit.
6. That, my client has received the last monthly rent of Rs. 8, 500/- through cheque no.004728, dt. 24-May-11 for the month of March.
7. That, my client had written several letters and reminders regarding getting the possession of the said flat/unit and issuance of monthly rental cheques for the months of April to July in the Marketing office at Khelgaon, Ranchi and the same letters were received by the Marketing office at Khelgaon, Ranchi on14/05, 12/07 and 20/08, Despite of, my client had not received neither oral nor any written information as yet, in this regard.
8. That, Further, my client were made several queries as mentioned in para-7 of this notice to Mr. Ajay Anand Pathak (Officer Accounts) and Mr. Ajay Kumar (Executive-Marketing & Sales) in the Marketing office at Khelgaon, Ranchi, they stated, since, they have not any information in the said context, since, they were unable to explain the reason under what circumstances, the issuing Authority not issuing the monthly rental cheques to Allottees.
9. That, you do not have any intention to pay/issue cheque of monthly rent of Rs. 8, 500/- (Rupees eight thousand five hundred) only, on or before 7th of every month for the preceding month against the booked 2 BHK flat/unit till handing over the said unit as per “Rental Scheme Agreement for Allottees at NGHC, Khelgaon, Ranchi” to my client.
You are, therefore, required, through this notice, to make the payment of Rs. 8, 500/-(Eight thousand five hundred) only for each month (i.e., April to July) through cheques alongwith Legal consultancy charges of Rs. 2, 500 (Two thousand five hundred) only for serving notice upon you to my client within fifteen days, after receiving of this notice, failing which, my client shall be compelled to take resort to legal procedding at your cost without any further reference.,
