Not providing replacement for maid

I am Dr Ashish Chakravarty, living in a nuclear family comprising my wife (also a doctor), and a 11/2 year old kid. On the 26th of Feb we had approached Anju Placement Services, Village Mohammadpur, New Delhi for a domestic help to look after our kid. We had clearly told them that we need the maid as an emergency basis as my wife was not able to join her new job because there would be nobody at home to look after the kid in her abscence. To that the agency had demanded a registration fee of Rs. and had provided us a maid within 2 days on 28th Feb with a commission of Rs. 15000 (for which a receipt was given) and Rs 4000 as advance of the maid's first month salary (for which no receipt was given). The terms of the contract was that in case we did not like the maid there would be 3 replacements over 11 month period after which the contract has to be renewed

The maid was working well, with the only problem that she used to receive phone calls at odd hours (12.30 -1.00 at night) which used to be very annoying for us. The phone calls did not stop even after telling her that it was not acceptable to us. But as she did not pay heed we stopped pursuading her.

After 9 working days the maid started showing signs of early pregnancy. Upon confronting her she agreed to have had sex with a worker at her previous employer's house. She declined to give further information about the person involved. When she missed her menses cycle we confirmed the pregnancy by doing her urine test with our own expense. We informed the agency about this and asked for a replacement. Knowing fully well that it is difficult to get domestic helps we had told them that we are still willing to keep the same maid provide she gets herself aborted from a government recognized hospital.

She was handed over to the agency on the 31st of March. Ever since we haven't got any replacement from the agency, nor has the maid's abortion been conducted. We have repeatedly requested the agency that absence of maid is causing us a lot of physical and mental tension and is also leading to our economical loss as my wife is not able to attend her regular clinics. We have also requested them to pay back our money (Rs. 17000) in case they cannot find us a maid, so that we can approach a different agency. This proposal has also been turned down by the agency.

We are in a great dillema as we do not have a domestic help, and her absence is causing us a lot of physical, mental, and economical strain. Please help us with your valuable advice.
