Reluctance to replace malfunctioning abs during warranty period

I have purchased an i20 Asta car from Popular Hyundai Neeramankara, Karamana Trivandrum Kerala India In January and having an extended warranty up to 2013 January. On May 5th I have registered a

complaint at Popular Hyundai Neeramankara for the malfunction of ABS (Bill Invoice No: B201206053, R/O No; 201206442). Those who were attended my complaint, after having a long check up they told me that there is a malfunction in the ABS Module and it should be replaced and can be done with in 10days, and they promised that till then I can drive the car without any worries as technically there is no problem to drive.

But unfortunately on May 10th morning I met with an accident. I had to hit on the back of a Tavera due to malfunctioning of brakes. I had to spent Rs. 44, 000 to get it repaired. (Bill Invoice No: TPC000393, TPC000112, TPC000369 Dated 16/5, 17/5, 21/5) And also I have to tell that if you could arrange a spare. I could have saved this Rs. 44, 000 if you had replaced ABS on time, or they could have warned me not to drive till the ABS get replaced. I have opted to buy i20 Asta just because it has all required saftey features for Indian roads. The accident happened because of your poor service, ie cant able to change the part when the complaint raised and the wrong advice of your service managers, so I lost my money and time, so who will pay for it

The real saga of the problem is with the Service of the Hyundai company. I had to call several people in Hyundai to probe the status of my ABS replacement. To my surprise no one from the company is taking responsibility. At least nobody there to attend my issue. From the service centre I am getting so many deadlines for this replacement, they are also irresponsible and helpless. I had a bitter experience with the customer care department and other departments. At last I got an answer from Mr. Thomas from Chennai, that the ABS module has to come from Korea and it will take at least one month (which is already over). Are they not fitting ABS in new cars? My assumption is that once they sold a vehicle, then the safety of the car is not their headache. Also I have to doubt the quality of the ABS.

After spending over 6.5 lakhs I have to let my vehicle rest on my car porch, as I am afraid to drive the car without these safety features.

Has any one seen Hyundai's advertisement "New possibilities and New thinking" - The real meaning is - New possibilities of safety failures, New thinking of never replace when it is in warranty period.

I have already discussed with the State Consumer Court, to deal with this. Hope only they can get justice for this injustice.
