Non receipt of product

I have ordered an samsung (C) star mobile phone through India today book club on 9th dec and made the payment of it immediatly through 2 credit cards of hdfc bank and till today it hasnt been delivered, and any time i call the custmoer care i get some new things to hear.

1. i called on 21st of dec the representative told me that by 30th dec it will be delivered.

2. when i called on 30th after not getting the delivery the representative told me it will take 7 more days when i said i want the confirmation he told me to mail to [email protected] and you will get the written confirmation, i did that the same time but till today i didnt get any confirmation.

3. when today i.e. 2nd jan i called the call center they told me that that payment is not received thats why your mobile is not send, and again he asked for 7 days time.

but the fact is that the payment of 10098/- Rs. is made on the same day i.e.9th of dec i have the bank credit card statement with me.

Now what should i do i want an action against them not only my mobile to be delivered to me but also they should be penalised for there cheating they do very delibratly.
