Sub: Reg refund of money on non receipt of product

Sir

I booked an office kit over phone on 18/02/09 with India Today Book Club costing Rs 2799/-- and paid the amount by my credit card on the same day over phone.

2. According to them, the product will reach to me within 14 days but till now I have not received the product. The details of the order are as below:

Membership no.-ITBC-09875456 booking date 18/02/09

Booking ID -110003086

Consignment no. 43569702120 by Blue Dart courier date 27/02/09.

3. I called to India Today Book club about non receipt of product and complaint about this 5 times as below:

On 17/03/09 to Mr Anant Complaint no: 24137

On 02/04/09 to Mr Amit Complaint no: 49351

On 02/0-04/09 to Mr Jitender Complaint no: 49902

On 13/04/09 to Mr Rvinder Complaint no: 63586

On21/04/09 to Mr Ashutosh Complaint no: 75212

On 21/04/09 to Mr Justin Fernades Complaint no: 75255

4. Everyone responded that you will receive the product within next 4 working days but not yet received and am mentally harassed. And no action has been taken on the complaints as the product has not delivered to me onmy residential add as: Qtr no 222, CRPFqtrs, Sector 16-b Dwarka New Delhi -75.

5. I requested them to cancel the order and remit me Rs2799/-- with interest, they say either to mail or write us to cancel the order and no interest will be give as per their policy Whereas I am of the opinion that when order can be taken over phone, it can be cancelled over phone after verifying the identity.

6. It is therefore requested to kindly look into the matter so that my money be returned with interest and I be compensated for the mental harassment and coy makes consumer friendly policies so that customers are not harrased

Any how i havent receved your product till now and fed up with your answers on your call centres citing one or othr reasons for non delivering the product. and feels very much harrased and cheated and wants to cancel the order wih the condition to refund my money back with interst which your telecallers refused saying such refund is not in their company policy. I was neither told during booking the product that after paying for the product neither the product will be deliverd nor refund wil be done.

NOW I HAVE NO OPTION LEFT THAN TO MOVE CONSUMER COURT .

I therefore request to kindly mail me the full detail of my conversation from the date of booking to various complaints made by during the period to present before the court.

HOPE YOU WILL SEND THE DETAILS AT THE EARLIEST.
